Wessex Water Services Limited (“we” or “us” or “our”) respects the data protection rights of our users (“user” or “you”). This Privacy Notice explains how we collect, use, disclose, and safeguard your information when you use our mobile applications “EQMobile” and “Pollution Register” (together the “Apps”). Please read this Privacy Notice carefully.

This Privacy Notice does not apply to the third-party online/mobile store from which you install the Apps. We are not responsible for any of the data collected by any such third party.

How we collect your information and our lawful bases for processing

The information we may collect via the Apps depends on the content and materials you use, and includes:

Personal Data

We collect and store all personal information related to use of the Apps, which you give us either upon sign-up or through continued use of the Apps and such information is processed to carry out a task in the public interest in monitoring effluent quality and registering pollution incidents to meet regulatory requirements:

  • Data related to information to authenticate the Apps you are using, in the form user company username
  • Details related to the ongoing use of the Apps in the form of transactions stored in databases, for the purpose of monitoring, reporting, and auditing these transactions.

Access to your device’s camera function and uploading media

Information we automatically collect when you access the Apps, such as the actions you take that are integral to the Apps, actions taken when creating entries, editing entries and uploading media to the Apps. As such, we will request access to your device camera so we can upload photographs to Pollution Register and to your mobile device’s storage to save images uploaded. EQMobile uploads effluent quality readings to our servers hosting the EQ storage database. We rely your consent to use your mobile device in this way.

Access to your device’s network connection status

EQMobile accesses your mobile device’s network connection status to ensure that sufficient bandwidth is available to enable submission of information to our storage database. We rely your consent to use your mobile device in this way.

Access to GPS information

Pollution Register tracks location-based information from your mobile device so it can be used to positively identify an incident location through mapping technologies. We rely your consent to use your mobile device in this way.

How we use your information

Specifically, we may use information collected about you via the Apps to:

Ensure compliance with statutory auditing requirements by maintaining records for any readings taken or incidents recorded.

Sharing your information

We may share information we have collected through the Apps which relate to you in certain situations.

  • To comply with any court order or to respond to any government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the safety, rights and property of employees, our customers or third parties. This may include exchanging information with other organizations for the purposes of the prevention or detection of crime or the apprehension or prosecution of offenders.

How long we retain your information

We will keep your information collected through the Apps for the retention periods required under our obligations contained within the Environmental Permitting Regulations (England and Wales) 2010, as follows:

Your rights

You have a series of rights to do with the information we hold about you. These are:

  • Your right to be informed – this Privacy Notice is an example of this. We may need to update this Privacy Notice if we need to do something different with your information and so we may change it from time to time. Please check the Privacy Notice for updates.
  • Your right to rectification - it is important that the information we are holding is accurate and up to date so if you think any of your information is incorrect or needs updating then let us know and we will update it as soon as we can.
  • Your right of ‘access’ - you have the right to request a copy of the personal information that we hold about you. Please email requests to dpo@wessexwater.co.uk.
  • Your right to erasure – as an individual, you have the right to request that your personal information be deleted where there is no longer a legitimate purpose for it being processed.
  • Your right to restrict processing or to object to our use of it – you have the right to ask us to restrict or suppress our use of your personal data or to object to us carrying out that processing but we may decide that we are unable to comply with such requests. 

Where we store your information

All the information processed through the Apps is stored on our secure servers.

Wessex Water Group’s IT development services is based outside of the European Economic Area. Some development projects may involve them working with your information. If this happens, we will take proper steps to keep your information safe through European Union approved contracts and by making sure your information stays protected within our own UK security arrangements using high standards of encryption in any transfer.

If you’re not happy and have issues with the way we’ve dealt with your information or your rights then please let us know by contacting us as below. If you remain unhappy with our response then you can ask the Information Commissioner’s Office (ICO) to comment.
